Human Trafficking Defense

Trafficking is the most aggressively expanded charge in Florida criminal law. What began as a statute aimed at organized exploitation now sweeps in boyfriends of women in prostitution, motel operators along the 192 corridor, drivers, roommates, and participants in commercial sex cases recast as “trafficking” — because the statute reaches anyone who knowingly benefits from a venture, and because every escalation of the past decade points one direction: as of October 1, 2025, Florida law authorizes the death penalty for the worst variant.

These prosecutions carry life-altering minimums, registration consequences, and task-force resources behind them. They are also frequently built on accomplice testimony and assumptions about knowledge that cross-examination can challenge. If you've been arrested or approached by a task force, say nothing and call or text 407-846-8008.

The Charges Under § 787.06

• First-degree felonies (up to 30 years): engaging in — or benefiting financially from participating in — a venture that traffics for labor or services (by coercion, for adults) or commercial sexual activity (by coercion, for adults), with transport variants punishable by up to life. The statute reaches conduct done knowingly or “in reckless disregard of the facts” — a lower mental state than most people assume, and one of the reasons these charges sweep so wide.

• Life felonies: commercial sexual activity involving a minor — or someone mentally defective or incapacitated — where no coercion need be proven, and neither consent nor ignorance of age is a defense; also a parent's sale or transfer of custody of a child for exploitation.

• Capital human trafficking — new in 2025: an adult who initiates, organizes, finances, directs, or supervises a venture sexually exploiting a child under 12 or a mentally incapacitated person commits a capital felony — death or life, with the State required to notice a death demand within 45 days of arraignment.

• Causing great bodily harm reclassifies charges upward; permanent branding of a victim is its own felony; and the listed sex-trafficking variants carry sex offender registration — with the 2025 law adding mandatory sexual predator designation for its new capital offense.

Where the Defense Lives

• Mental state and “participation in a venture.” The statute's reach is broad — it covers knowing conduct and “reckless disregard” — but even reckless disregard requires proof of what the defendant was actually aware of and ignored. The motel clerk, the rideshare driver, the roommate who shared rent — proximity to someone else's prostitution is not trafficking, and the State's theory often rests on inference stacked on inference.

• Coercion, in adult cases, is an element — and the difference between exploitation and a voluntary (if unlawful) commercial arrangement between adults is the difference between trafficking and a prostitution case with misdemeanor exposure. Messages, money flows, and freedom of movement tell that story.

• Accomplice and cooperator testimony. Trafficking cases are built on witnesses working off their own charges — bias a jury is entitled to hear about, in detail.

• The sting variants. “Believed to be a minor” operations and reverse stings raise the same entrapment and intent defenses as online solicitation cases.

• Degree warfare. With minimums, registration, and now capital exposure tied to victim age and role-in-venture findings, contesting which subsection — organizer versus participant, coercion versus none, age proof — is contesting decades.

Frequently Asked Questions

My girlfriend was arrested for prostitution and they charged me with trafficking.

The “boyfriend as trafficker” theory is now standard — built on money transfers, hotel bookings, and texts. It's also defensible: coercion and knowing-exploitation are elements, not assumptions.

I rented rooms / drove someone. How am I in a trafficking case?

“Benefiting from a venture” charges against service providers turn largely on what you knew. Don't explain to the task force — that interview is where the State tries to establish knowledge.

They mentioned federal charges too.

State and federal trafficking exposure often run parallel; the state defense must account for federal exposure from the first day.

Is the death penalty really on the table?

For the new capital variant involving children under 12 — yes, by statute, for offenses on or after October 1, 2025, and its constitutionality will be litigated just as the capital sexual battery law is. No one should face that uncertainty without counsel who follows it.
