Poinciana Criminal Defense
Poinciana has a legal quirk most of its 70,000-plus residents never think about until the night it matters: the community straddles the Osceola–Polk county line. Under Florida law, a criminal case is generally tried in the county where the alleged offense occurred (§ 910.03, Fla. Stat.) — so which side of that line the incident happened on ordinarily decides which jail holds you, which courthouse hears the case, and which State Attorney's office prosecutes it. An Osceola-side case goes to the Osceola County Courthouse in Kissimmee (Ninth Judicial Circuit); a Polk-side case goes to Bartow (Tenth Judicial Circuit) — two different prosecutors' offices with different programs, policies, and tendencies. (The arresting agency can be either county's sheriff or a statewide agency like FHP; the paperwork, not the uniform, tells you where the case lives.)
Don Waggoner Law, P.A. defends clients throughout Central Florida, and the first thing we do with a Poinciana case is pin down exactly where it lives. Call or text 407-846-8008 — free consultation, and hablamos español.
The Charges We See Most from Poinciana
Poinciana is a commuter community — most working adults drive long distances on Poinciana Parkway, Cypress Parkway, and Pleasant Hill Road every day. That shapes the caseload:
• Driving while license suspended (DWLS) — one of the most common charges in any commuter community, and one of the most underestimated. Three convictions can make you a habitual traffic offender with a five-year revocation. There are ways out of the cycle; pleading to “get it over with” is not one of them.
• DUI — enforcement concentrates on the parkways and on US-17/92 and Highway 27 at the community's edges, where the county line can sit in the middle of a single traffic stop.
• Domestic violence — a 911 call brings whichever sheriff patrols that side of the line, and the no-contact order that follows can push you out of your home overnight.
• Drug possession and juvenile cases — including school-related incidents, where early intervention can keep a teenager's mistake from defining their record.
• Warrants and failure to appear — missed court dates in either county, often discovered years later at a traffic stop. We work to resolve warrants on both sides, ideally with a scheduled surrender instead of a 2 a.m. arrest.

Frequently Asked Questions
How do I know which county my case is in?
Your paperwork says — the arresting agency and the court listed on the notice to appear or bond papers. Bring us whatever you have (or just the arrestee's name and birth date) and we'll help find the case quickly.
My relative was arrested in Poinciana tonight. Where are they?
Cases arising on the Osceola side are generally booked at the Osceola County Jail on Simpson Road in Kissimmee; Polk-side cases at the Polk County Jail. For adults taken into custody, first appearance happens within 24 hours either way — and a lawyer at that hearing can argue for lower bond and better conditions.
Does it matter which county charges me?
Practically, yes — diversion programs, plea policies, and courtroom practices differ between the Ninth and Tenth Circuits. The charge is the same statute statewide; how it resolves often isn't.
