Penalty Chart for Misdemeanors

2nd  Degree Misdemeanor:                                   60 days Jail, 6 months probation, $500.00 Fine

1st Degree Misdemeanor:                                           1-year Jail, 1-year probation, $1000.00 Fine

3rd  Degree Felony:                                              5 years prison, 5 years probation, $5,000.00 fine

2nd  Degree Felony:                                       15 years prison, 15 years probation, $10,000.00 fine

 

 

1st  Degree Felony:                               

30 years to LIFE in prison, 30 years to LIFE probation $10,000.00 fine

Capital Felony:                LIFE in prison or Death

Use of Firearm:

Minimum Mandatory Prison  - 10 years if firearm is carried or acquired during the commission of a crime, 20 years if a firearm is discharged, and LIFE if a firearm is discharged and someone is struck by the bullet.

The sentence can be doubled if you are convicted as a Habitual or Violent Felony Offender; for most Sex Offenses, you can spend many years in a mental health facility for sex offenders after your sentence under the JIMMY RYCE ACT, plus you will be designated as a sexual offender or sexual predator for life, and you will have to register with the sheriff every year and every time you move.

Drug Crime Minimum Mandatories

For crimes involving drug trafficking, a minimum mandatory sentence must be imposed.  The minimum mandatories are 3 years, 7 years, 15, years, and 25 years, depending on the amount of drugs involved.

Minimum Mandatory Penalties in General

Minimum mandatory sentences are not required to be served day for day in most cases.  However, most sex crimes require a day for day sentence.  A minimum mandatory sentence is just that – a judge may not sentence you to any less than the minimum number of days or years required for the particular crime, but may sentence up to the maximum allowed for the crime.  A minimum mandatory sentence takes precedence over the normal maximum penalty for a crime.  In other words, if the normal maximum penalty for the crime was 5 years, but you carried a gun during the crime, the judge would be required to sentence you to a minimum of 10 years in prison.
