FORMAL REVIEW HEARING

Why Is It Important?

You only have 10 days
It's the only way you can get your license back
You get at Least 30 more days to Drive
An attorney is important
Your DUI ticket gives you ten days to drive and ask for a formal review hearing. Requesting a hearing gets you another 30 days to drive-valuable time if you need to make arrangements for not having a license.

At the hearing, a hearing officer will hear the facts and make a finding of whether you were legally arrested. If the officer finds in your favor, you will get your license back.


If the hearing officer doesn’t find in your favor, what happens?


If you gave a voluntary breath test, you will lose your license for 6 months, and must wait at least 30 days before you can get a temporary (business purpose) license.
If you refused the breath test, your license will be suspended for 1 year, and you must wait 90 days to get a temporary license.
In either case, you must take the DUI class to get a temporary license or your permanent license back.
Remember, the administrative suspension of your license is different than the suspension the court gives.
